1. Acceptance of Terms
By creating an account or ticking the box on the registration page, you agree to be bound by these Terms of Use (“Terms”). If you only browse the Platform, these Terms still apply to your use of it. If you do not agree, stop using the Platform.
These Terms apply to all visitors, registered Users (homeowners and individuals) and Advertisers (trade professionals and service providers). You must be at least 18 years old and able to enter into a contract. Please read them together with our Privacy Policy, Cookie Policy and Our Commitments. A French version of these Terms is available at [link to French version].
2. What Loovy.ca Is — Advertising Platform Only
Please read carefully. Loovy.ca is an online classified advertising platform. It allows Advertisers to post advertisements and allows Users to discover them. Using the Platform is currently free.
Loovy.ca is NOT:
- A contracting company
- An employment agency or staffing service
- A general contractor or subcontractor
- A guarantor of any service, work or outcome
- A licensed trade authority or regulatory body
- A party to any agreement, contract or transaction between a User and an Advertiser
Loovy.ca does NOT:
- Employ, supervise, direct or control any Advertiser listed on the Platform
- Participate in, oversee or supervise any work, project or service performed by an Advertiser
- Guarantee the quality, safety, legality, completeness or outcome of any service advertised on the Platform
- Verify an Advertiser’s insurance, skills, references or work history
- Handle, manage or take responsibility for any payment between a User and an Advertiser
Limited document review. Before an Advertiser’s profile and listing are published, the Loovy team may review the government-issued ID and trade licence the Advertiser submits. This is a limited check that the documents appear valid and match the profile. It does not confirm that a licence is currently in good standing with the issuing body, and it does not confirm insurance or the quality of any work. A “Verified” badge means only that this review was completed. Users must still carry out their own due diligence.
3. No Responsibility for Advertisers
To the extent permitted by law, Loovy.ca is not responsible for the Advertisers listed on the Platform or for the following:
- Quality of work: defects, errors, omissions, delays, failures or unsatisfactory results in any work performed by an Advertiser found through the Platform.
- Licensing and certifications: whether an Advertiser holds the valid, current licences, certifications and permits required by provincial or federal law (for example, a Régie du bâtiment du Québec (RBQ) licence in Quebec). Users must verify this independently before hiring.
- Insurance: whether an Advertiser carries adequate liability insurance or workers’ compensation coverage (for example, CNESST in Quebec, WSIB in Ontario, or WCB elsewhere).
- Property damage: damage to property caused by an Advertiser during or after a service.
- Personal injury: bodily injury, death or harm suffered by any person as a result of services performed by an Advertiser.
- Financial disputes: disputes about payment, pricing, overcharging, non-payment, lost deposits, fraud or financial misconduct between a User and an Advertiser.
- Contractual disputes: breach of contract, failure to complete work, abandonment of a project or any disagreement arising from an agreement between a User and an Advertiser.
- Criminal or fraudulent conduct: fraudulent, deceptive, criminal or illegal conduct by an Advertiser.
- Misuse of personal information: any misuse of information that a User shares directly with an Advertiser outside the Platform.
4. User Responsibilities
4.1 Users (homeowners and individuals)
By using Loovy.ca to find a trade professional, you acknowledge and agree that:
- You are responsible for your own due diligence before hiring any Advertiser
- You should check the Advertiser’s licence, insurance, credentials and references yourself
- Any agreement or contract you make with an Advertiser is between you and that Advertiser
- Any payment you make is made directly to the Advertiser. Loovy.ca is not a party to that transaction.
4.2 Advertisers (trade professionals and service providers)
By registering as an Advertiser, you acknowledge and agree that:
- You are responsible for the accuracy of everything in your profile and listings
- You hold all licences, permits and insurance required by your province and trade, and you will tell us promptly if any of them lapses or is suspended
- The ID and licence documents you submit are genuine and belong to you or to your business
- You will not display a “Verified” badge or claim verification unless Loovy.ca has granted it
- You operate as an independent business or self-employed individual, not as an employee or agent of Loovy.ca
- You are responsible for the quality and safety of the work you perform
4.3 Accounts and acceptable use
Keep your password confidential and tell us if you suspect unauthorized access. You may not post content that is unlawful, misleading, discriminatory or infringes someone’s rights, publish fake reviews, send spam, or scrape or copy the Platform’s data in bulk.
4.4 Suspension and closure
We may remove listings, suspend or close accounts that break these Terms or that rely on false documents or information. You can close your account at any time from your account settings or by emailing support@loovy.ca.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Loovy.ca and its owners, directors, employees, partners, affiliates and agents are not liable for any:
- Indirect, incidental or consequential damages
- Loss of revenue, profit, data or business opportunity
- Claim arising from the use of, or inability to use, any service found through the Platform
Because the Platform is currently free, Loovy.ca’s total liability to any person for claims relating to the Platform will not exceed CAD $100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intentional or gross fault or for bodily or moral injury (Civil Code of Québec, art. 1474), or any right you have under consumer protection law.
6. Disclaimer of Warranties
The Platform and all content, listings and information on Loovy.ca are provided “as is” and “as available”, without warranty of any kind, express or implied, including as to:
- Accuracy or completeness of listings
- Fitness for a particular purpose
- Non-infringement of third-party rights
- Availability or uninterrupted access to the Platform
Loovy.ca makes no representation that any Advertiser is qualified, licensed, insured or trustworthy. Statements made by Advertisers are their own. A “Verified” badge reflects only the limited document review described in Section 2.
7. Third-Party Content
Listings, profiles, photos, descriptions, pricing and claims on Loovy.ca are created and submitted by Advertisers. Loovy.ca does not endorse them and is not responsible for their accuracy, truthfulness or legality.
Advertisers confirm that they have the right to publish the content they submit, and give Loovy.ca a non-exclusive, royalty-free licence to display it on the Platform and in Loovy.ca’s promotion of the Platform, for as long as the listing is published.
8. Indemnification
Advertisers agree to indemnify and hold harmless Loovy.ca and its owners, officers, directors, employees and agents against claims, losses and costs (including reasonable legal fees) arising from their listings, their services or their breach of these Terms or of applicable law.
Users are responsible for losses that Loovy.ca suffers because they breached these Terms, to the extent permitted by law.
9. Governing Law
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable there. Disputes arising from these Terms or the use of the Platform fall under the jurisdiction of the courts of Montréal, Quebec, subject to any right a consumer has by law to bring proceedings in the courts of their place of residence.
10. Changes to These Terms
We may update these Terms. For material changes we will give at least 30 days’ notice by email to registered users and by a notice on the Platform’s homepage. If you keep using the Platform after the change takes effect, you accept the revised Terms, unless the law requires your express consent. If you do not agree, you can close your account.
