1. ACCEPTANCE OF TERMS
By accessing or using the website Loovy.ca (the “Platform”), registering an account, browsing listings, or contacting any professional listed on this Platform, you (“User”) agree to be fully bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must immediately stop using the Platform.
These Terms apply to all visitors, registered users, homeowners, and trade professionals who access or use the Platform in any way.
2. WHAT LOOVY.CA IS — ADVERTISING PLATFORM ONLY
⚠️ IMPORTANT — PLEASE READ CAREFULLY
Loovy.ca is strictly and exclusively an online advertising and classified listings platform.
Loovy.ca acts solely as an intermediary advertising service that allows trade professionals and service providers (“Vendors”) to post advertisements and allows homeowners and individuals (“Clients”) to discover those advertisements.
Loovy.ca is NOT:
- A contracting company
- An employment agency
- A staffing service
- A general contractor or subcontractor
- A guarantor of any service, work, or outcome
- A licensed trade authority or regulatory body
- A party to any agreement, contract, or transaction between a Client and a Vendor
Loovy.ca does NOT:
- Employ, supervise, direct, or control any Vendor or trade professional listed on the Platform
- Verify, certify, validate, or guarantee the qualifications, licenses, insurance, skills, or identity of any Vendor
- Participate in, oversee, or supervise any work, project, or service performed by any Vendor
- Guarantee the quality, safety, legality, completeness, or outcome of any service advertised on the Platform
- Handle, manage, or be responsible for any payment made between a Client and a Vendor
3. NO RESPONSIBILITY FOR PROFESSIONALS OR VENDORS
Loovy.ca assumes absolutely no responsibility, liability, or accountability of any kind for the trade professionals, vendors, or service providers listed on this Platform.
Specifically, Loovy.ca shall not be held responsible for:
3.1 Quality of Work
Any defects, errors, omissions, delays, failures, or unsatisfactory results in any work performed by a Vendor found through the Platform.
3.2 Licensing & Certifications
Whether a Vendor holds valid, current, or appropriate licenses, certifications, permits, or qualifications required by applicable provincial or federal law. It is the sole responsibility of the Client to verify this independently before hiring.
3.3 Insurance
Whether a Vendor carries adequate liability insurance, WSIB/WCB coverage, or any other form of insurance required by law or industry standards.
3.4 Property Damage
Any damage to property — real, personal, or otherwise — caused by a Vendor during or after the performance of any service.
3.5 Personal Injury
Any bodily injury, death, or harm suffered by any person as a result of services performed by a Vendor discovered through the Platform.
3.6 Financial Disputes
Any disputes regarding payment, pricing, overcharging, non-payment, deposit loss, fraud, or financial misconduct between a Client and a Vendor.
3.7 Contractual Disputes
Any breach of contract, failure to complete work, abandonment of a project, or disagreement arising from any agreement made between a Client and a Vendor.
3.8 Criminal or Fraudulent Conduct
Any fraudulent, deceptive, criminal, or illegal conduct by any Vendor listed on the Platform.
3.9 Data or Privacy Breach by Vendors
Any misuse of personal information or data shared directly by a Client with a Vendor outside of the Loovy.ca Platform.
4. USER RESPONSIBILITIES
4.1 Clients (Homeowners / Individuals)
By using Loovy.ca to find a trade professional, you acknowledge and agree that:
- You are solely responsible for conducting your own due diligence before hiring any Vendor
- You must independently verify a Vendor’s license, insurance, credentials, and references
- You enter into any agreement or contract with a Vendor entirely at your own risk
- Loovy.ca has no involvement in and no liability for the outcome of any services you hire
- Any payment you make to a Vendor is made directly between you and that Vendor — Loovy.ca is not a party to that transaction
4.2 Vendors (Trade Professionals / Service Providers)
By registering as a Vendor on Loovy.ca, you acknowledge and agree that:
- You are solely responsible for the accuracy of all information posted in your profile and listings
- You must hold all valid licenses, permits, and insurance required by your province and trade
- You are independently operating as a business or self-employed individual — not as an employee or agent of Loovy.ca
- You are solely responsible for the quality and safety of all work you perform
- Loovy.ca is not liable for any disputes, complaints, or legal actions arising from your services
5. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW:
Loovy.ca, its owners, directors, employees, partners, affiliates, and agents shall not be liable for any:
- Direct, indirect, incidental, or consequential damages
- Loss of revenue, profit, data, or business opportunity
- Property damage or personal injury
- Emotional distress or reputational harm
- Any claim arising from the use of — or inability to use — any services found through the Platform
IN NO EVENT SHALL LOOVY.CA’S TOTAL LIABILITY TO ANY USER EXCEED THE AMOUNT PAID BY THAT USER TO LOOVY.CA IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 CAD — WHICHEVER IS LOWER.
6. DISCLAIMER OF WARRANTIES
The Platform and all content, listings, and information on Loovy.ca are provided “AS IS” and “AS AVAILABLE” without any warranty of any kind, either express or implied, including but not limited to:
- Accuracy or completeness of listings
- Fitness for a particular purpose
- Non-infringement of third-party rights
- Availability or uninterrupted access to the Platform
Loovy.ca makes no representation that any Vendor is qualified, licensed, insured, or trustworthy. All representations made by Vendors are their own and are not endorsed or verified by Loovy.ca.
7. THIRD-PARTY CONTENT
All listings, profiles, photos, descriptions, pricing, and claims published on Loovy.ca are created and submitted solely by Vendors. Loovy.ca does not verify, endorse, or take responsibility for the accuracy, truthfulness, or legality of any third-party content posted on the Platform.
8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Loovy.ca, its owners, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of or related to:
- Your use of the Platform
- Any transaction or agreement between a Client and a Vendor
- Your violation of these Terms
- Your violation of any applicable law or regulation
9. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, and the federal laws of Canada applicable therein. Any legal disputes arising from these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Montreal, Quebec.
10. CHANGES TO THESE TERMS
Loovy.ca reserves the right to modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting to the Platform. Your continued use of the Platform following any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
